Terms and Conditions for Steadfast Group

1. Introduction

1.1 Welcome to Steadfast Group. These Terms and Conditions are an agreement that govern your use of our mobile application and services (the "App") provided by Steadfast Group, a registered organization incorporated in Kenya and regulated under the laws of Kenya and the users (“you”) of our App and Steadfast’s website (Steadfastgroupkenya.org)

1.2 By accessing or using this App, you agree to comply with and be bound by these Terms and Conditions, our Privacy Policy, and any other policies that may be introduced from time to time.

2. Definitions

2.1 "We", "Our", "Us", and "Company" refer to Steadfast Group.
2.2 "You" and "Your" refer to the user of the App.
2.3 "Loan" refers to the amount of money that is borrowed by a user through the App and is subject to repayment as per the terms outlined in the Loan Agreement.
2.4 "Repayment Period" refers to the duration within which the Loan must be repaid.
2.5 "Interest Rate" refers to the percentage rate charged on the loan amount as specified in the Loan Agreement.

3. Eligibility

3.1 To use the App and access our services, you must be at least 18 years old and a Kenyan citizen or resident.
3.2 You must have a valid phone number, email address, and a national ID or other identification recognized in Kenya.
3.3 By using this App, you confirm that the information you provide is accurate, complete, and up-to-date.

4. Services Provided

4.1 The App allows you to apply for and receive microloans based on the information you provide, subject to approval.
4.2 The amount of the loan, the interest rate, and the repayment terms will be displayed in the Loan Agreement, which you must accept before receiving funds.
4.3 The App may provide other services, including loan repayment reminders, access to loan history, and updates on loan status.

5. Loan Application Process

5.1 To apply for a loan, you must complete an application form on the App, providing personal information and any other required details.
5.2 Your application will be reviewed by us, and a decision will be made based on our internal assessment criteria, which may include your credit history, income, and other factors.
5.3 If your loan is approved, the loan amount will be transferred to your mobile money account, as per the details you provided.

6. Interest Rates and Fees

6.1 The interest rate applicable to the loan will be communicated to you at the time of loan approval.
6.2 You will also be informed of any processing fees, late fees, or other charges that may apply.
6.3 All fees and charges will be clearly outlined in the Loan Agreement before you accept the loan.

7. Repayment Terms

7.1 You agree to repay the loan in full within the specified repayment period, which will be outlined in your Loan Agreement.
7.2 You are responsible for ensuring that your loan is repaid on time, and failure to do so may result in additional charges, penalties, or restrictions on future loans.
7.3 Repayments will be made via mobile money (e.g., M-Pesa, Airtel Money) or any other payment method we support.
7.4 If you fail to make payments on time, we reserve the right to report your default to credit reference bureaus (CRBs) and take appropriate legal action.

8. Late Payments and Penalties

8.1 If you fail to make a repayment by the due date, a late fee will be charged, and the interest rate on the loan may increase as specified in the Loan Agreement.
8.2 Persistent late payments may result in legal action, including the use of debt collection agencies and reporting to credit reference bureaus (CRBs).
8.3 You understand and agree that we may take legal action to recover any outstanding amounts.

9. Your Obligations

9.1 You agree to provide accurate, truthful, and complete information when using the App and applying for loans.
9.2 You will promptly notify us of any changes to your personal details, including phone number, email, or bank account details.
9.3 You will repay the loan in full and on time, in accordance with the terms outlined in the Loan Agreement.

9.4 You agree and acknowledge that you shall be solely responsible for the safekeeping and proper use of your mobile devices and for keeping your username, log in details and PIN secret and secure.

9.5 You shall ensure that your username, log in details and password does not become known or come into possession of any unauthorized person. Steadfast Group shall not be liable for any disclosure of your username, log in details and PIN to any third party and you hereby agree to indemnify and hold Steadfast Group harmless from any losses resulting from any username, log in details and PIN disclosure.

10. Termination of Account

10.1 We reserve the right to suspend or terminate your access to the App at any time if you violate these Terms and Conditions or if we suspect fraudulent activity. We shall block your access to the Services without giving any advance notice in case you breach these Terms, any applicable laws or regulations, disparage Steadfast, or cause harm to Steadfast’s brand, reputation or business as determined by Steadfast Group in its sole discretion. In the aforementioned cases Steadfast Group may, at its own discretion, prohibit you from registering a new account.

10.2 You may also close your account at any time, provided all outstanding loans are repaid in full.

11. Dispute Resolution

11.1 In the event of any dispute arising from the use of the App or these Terms and Conditions, you agree to attempt to resolve the dispute amicably through negotiation.

11.2 If the dispute cannot be resolved amicably, it will be referred to an accredited alternative dispute resolution (ADR) mechanism or court of competent jurisdiction in Kenya.

12. Limitation of Liability

12.1 We will not be liable for any loss or damage arising from the use of the App, except where such loss or damage is caused by our gross negligence or willful misconduct.
12.2 We are not responsible for any loss or damage resulting from third-party services, such as mobile money providers or banks, that may be used to process loans or repayments.

13. Governing Law

13.1 These Terms and Conditions will be governed by and construed in accordance with the laws of Kenya.

13.2 Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the Kenyan legal system.

13.3 The parties will attempt in good faith to negotiate a settlement to any dispute or differences between them arising out of or in connection with these Terms within Thirty (30) business days of either party notifying the other of the dispute or differences. The language of the arbitration shall be English.

14. Data Privacy and Security Policy

14.1 We value your privacy and are committed to protecting your personal information in accordance with the Data Protection Act (2019).

14.2 By using the App, you consent to the collection, storage, and processing of your personal data for the purpose of loan processing, repayment tracking, and communication.

14.3 We will not share your personal information without your consent, except where required by law or if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers, or others.

14.4 We may employ third party companies and individuals to facilitate our Service (“Service Providers”), provide the Service on our behalf, perform Service-related services or assist us in analyzing how our Service is used.

These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

14.5. We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page.

We will let you know via email and/or a prominent notice on our Service, prior to the change becoming effective and update “effective date” at the top of this document.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.

15. Amendments to Terms and Conditions

15.1 We reserve the right to update or modify these Terms and Conditions at any time. Any changes will be communicated to you through the App, through phone text messages or via email.
15.2 Your continued use of the App after any changes to these Terms and Conditions will constitute your acceptance of the new terms.
